Terms of Use, Expressions of Interest and Transactions

This website, wantacar.gr (the “Website”), is owned and operated by “ARGYRIOS KATSANTONIS LIMITED LIABILITY COMPANY”, trading as “WANTACAR”, with registered offices in Athens at 160 Liosion Street, Tax Identification Number 997780569, Athens A Tax Office (the “WANTACAR” or the “Company”).

The Website provides information about WANTACAR's activities and, among other things, enables users to view vehicles offered for sale, submit expressions of interest for the purchase of a vehicle, submit requests for Flexible Operating Lease vehicles, submit details for the sale or trade-in of a vehicle, and access related information services and tools.

These Terms of Use, Expressions of Interest and Transactions (the “Terms”) govern the use of the Website and the actions carried out through it.

Accessing, browsing or using the Website means that the user has been made aware of these Terms. Where express acceptance of specific terms is required before submitting a request or using a particular functionality, such acceptance is requested in the appropriate manner before the relevant action is completed.

These Terms apply to the use of the Website by individuals, consumers, professionals, businesses and other users.

Where the user acts as a consumer, all mandatory provisions of the applicable consumer protection legislation also apply. Nothing in these Terms is intended to, or may be interpreted as, a waiver by a consumer of any right granted by mandatory law.

Any specific terms agreed between the parties in relation to a particular offer, sale, trade-in or lease supplement these Terms and, with respect to the specific elements of that transaction, prevail over the general information displayed on the Website.

The Website primarily operates as a means of providing information, presenting vehicles and services and allowing users to submit expressions of interest.

Unless expressly stated otherwise, completing and submitting any form through the Website:

• does not constitute an order for a vehicle,
• does not constitute a reservation or commitment of a vehicle,
• does not constitute a sale or lease agreement,
• does not constitute acceptance of an offer,
• does not oblige WANTACAR to accept the request or enter into an agreement with the interested party,
• does not guarantee the availability of a specific vehicle, and
• does not oblige the interested party to complete the transaction unless a contractual commitment is subsequently undertaken.

The final transaction is completed outside the Website, following communication, any necessary checks, agreement between the parties and execution of the relevant contractual documents.

WANTACAR may display on the Website used or other vehicles that are available for sale.

Displaying a vehicle on the Website does not in itself constitute a binding offer of sale to any person or a guarantee that the vehicle will remain available at the time an expression of interest is submitted or at the time of subsequent communication.

Vehicle availability may change and a specific vehicle may be sold, reserved, withdrawn from sale or otherwise become unavailable without prior notice to the user.

Submitting an expression of interest for a specific vehicle does not reserve that vehicle for the interested party.

Any temporary reservation or commitment of a vehicle is made only following specific agreement with WANTACAR and in accordance with the terms communicated to the interested party for the particular case.

WANTACAR takes reasonable care to ensure that the vehicle information displayed on the Website is accurate and up to date.

Such information may include, indicatively, make, model, version, date or year of first registration, mileage, engine capacity, fuel type, transmission, equipment, colour, technical specifications, photographs and other information.

Despite the relevant checks, an obvious typographical, technical or inadvertent error, or the need to update specific information, cannot be completely excluded.

The material characteristics of the specific vehicle are confirmed before the sale agreement is concluded.

Photographs are intended to represent the specific vehicle as accurately as reasonably possible, although differences may arise due, among other things, to photography conditions, colour reproduction on different displays or other technical characteristics of digital presentation.

This provision does not limit the liability of the relevant seller or any rights of the buyer arising from mandatory provisions of applicable law.

Before completing a purchase, the prospective buyer may, by prior arrangement with WANTACAR, request that the vehicle be technically inspected by a workshop or technician of their choice.

The prospective buyer may carry out any reasonable inspection considered necessary before entering into the sale agreement, subject to prior agreement as to the time, location and manner in which the inspection will take place.

Whether or not the buyer carries out a pre-purchase inspection does not constitute a waiver of rights granted by mandatory provisions of applicable law and does not release the relevant seller from liability that cannot lawfully be excluded or limited.

The sale prices displayed on the Website include VAT where VAT applies under the relevant tax treatment of the vehicle.

Unless expressly stated otherwise, the displayed price does not include transfer costs, fees, costs relating to the issue or amendment of registration details or licence plates, or any other lawful administrative or government charges associated with the transfer or registration of the vehicle.

Before the transaction is completed, the interested party is informed of the agreed price and the specific financial terms of the relevant purchase.

In the event of an obvious error in the displayed price or another material financial element, WANTACAR may correct the relevant error before the agreement is concluded, after informing the interested party.

Submitting an expression of interest through the Website does not constitute the conclusion of a sale agreement.

The sale agreement is concluded outside the Website in accordance with what is agreed between the parties and the requirements of applicable law.

The Website does not provide functionality for online settlement of the purchase price of a vehicle.

Depending on the specific transaction and agreed terms, payment may be made by bank payment or transfer or by card at the physical premises.

Any specific terms relating to a deposit, reservation or temporary commitment of a particular vehicle are agreed separately with the interested party.
